In processing personal data, we aim to protect the fundamental rights and freedoms of individuals, particularly the right to privacy, in accordance with the Law No. 6698 on the Protection of Personal Data published in the Official Gazette dated April 7, 2016, and numbered 29677. According to Article 10 titled "Obligation of the Data Controller to Inform" and the Communiqué on the Principles and Procedures for Fulfillment of the Obligation to Inform published in the Official Gazette dated March 10, 2018, and numbered 30356, we aim to inform you about your personal data processed by Türk Telekomünikasyon A.Ş. and its group companies (collectively referred to as "Türk Telekom").
Türk Telekom takes all technical and administrative measures to prevent unlawful processing and access to your personal data, ensuring its protection.
PROCESSED PERSONAL DATA
Personal data refers to any information relating to an identified or identifiable person. The categories of your processed personal data are as follows:
- Identity Information: Name, surname, national ID number, place and date of birth, marital status, gender, ID serial and number, nationality, passport number, parents' names, mother's maiden name, photograph, ID sample.
- Contact Information: Phone/fax number, email address, address information.
- Subscription and Device Information: Subscriber identity/contact information/marketing data, customer numbers, service numbers according to the services and products received, subscription channel, segment information, e-invoice information, personal data that can identify the subscriber such as profession, device identity information, brand and model of the used device, device features, device change dates, type of modem used (ADSL/VDSL) and modem change dates, subscription type, plan and package information, quota and speed, line opening information, payment type, invoice and content information, financial and debt information, subscription status (canceled, active, suspended, etc.), automatic payment instructions, balance for prepaid customers, loading frequency, number of loads, subscription status with group companies, SIM card and SIM card change information, dealer code, xDSL number, IMEI number, activation date, mobile product device information.
Network and Traffic Information: Traffic data used for communication transmission and billing purposes, traffic control data, IP address, CDR traffic information, IMSI information.
Usage and Behavior Information: Traffic information, date, time, duration, and parties of calls made/sent or received messages/internet usage, behavior and trend information from Türk Telekom websites and mobile applications, cookies, usage of content such as films/music, information on subscriptions to value-added services/products/services and their usage, limit overage information, billing information.
Location Information: Estimated location data at the time of communication, the country where the user is located abroad, and any other location information.
Payment, Bank, and Risk Information: Personal security information related to payment instruments issued by organizations, such as passwords, security questions, certificates, encryption keys, PINs, card numbers, expiration dates, CVV2/CVC2 codes, credit score and risk status, payment information, branch codes, and account numbers.
Visual/Functional Record Information: Voice and/or video call recordings made in call centers, offices, and sales points, and personal data obtained when you contact us.
Special Category Data: Biometric data, fingerprints, health information indicating disability status, membership information for associations and foundations.
PURPOSES OF PROCESSING PERSONAL DATA
Your personal data may be processed for the following purposes in accordance with the processing conditions specified in Articles 5 and 6 of the Law and in compliance with secondary regulations:
- Establishing, providing, and ensuring the continuity of our services, and conducting infrastructure/service availability inquiries.
- Establishing subscriptions and performing other transactions during the subscription period, handling subscription termination, invoicing/pricing/refund/collection transactions.
- Providing customer services, addressing customer complaints/requests, and fulfilling all contractual obligations in this regard.
- Storing copies of your identity documents and other information that must be retained as required by relevant legislation, and verifying the accuracy of your declared identity information and documents.
- Conducting credit, income assurance, and risk assessments, credit scoring, managing risks related to collections, and detecting and preventing any malicious use such as fraud/abuse/misuse.
- Managing, measuring, auditing, and analyzing network traffic and conducting network improvement/optimization efforts.
- Developing products, services, and business operations in conventional and digital channels as part of network and technological advancements/improvements to provide better service.
- Proactively/reactively identifying faults that may occur during service delivery, determining the root cause of the problem, resolving it, and attempting to prevent its recurrence.
- Measuring customer satisfaction, researching customer trends, and conducting surveys/analyses aimed at improving service quality.
- Offering applications focused on ensuring customer satisfaction, such as rewards, giveaways, competitions, gifts, thank-yous, celebrations, and reminders.
- Preparing, presenting, promoting, tracking, reporting, and providing information regarding campaigns and offers for products and services based on our customers' usage.
- Informing our customers about new products/services, campaigns/tariffs, and other innovations, as well as conducting information and customer recovery activities and creating sales opportunities.
- Sharing information/documents requested by regulatory and supervisory institutions and official authorities, and conducting audits to fulfill legal obligations stipulated in relevant legislation.
- Determining your location in emergency call situations in accordance with applicable legislation.
- Establishing brand partnerships that touch on different sectors to increase product and service diversity and ensure that customers benefit from various opportunities.
- Ensuring the contractual requirements and financial reconciliation related to products and services offered jointly with our business partners or other third parties.
- Conducting legal follow-up and legal processes.
- Providing guidance services.
TRANSFER OF PERSONAL DATA
Your personal data may be transferred to the following third parties within the scope of the laws and relevant regulations, and for the purposes disclosed, in accordance with the provisions of the Law regarding the transfer of personal data domestically and internationally:
- Türk Telekomünikasyon A.Ş., TTNET A.Ş., TT Mobil İletişim Hizmetleri A.Ş., TT Ödeme Hizmetleri A.Ş., TTES Elektrik Tedarik Satış A.Ş., and all other group companies listed on the website www.ttyatirimciiliskileri.com.tr.
- Companies, representatives, and dealers that operate on behalf of our Company as authorized.
- Regulatory and supervisory institutions, authorized authorities that will determine your location in case of an emergency call, and public institutions or organizations legally authorized to request your personal data under applicable laws.
- Business partners, suppliers, and contractors, payment and e-money institutions, banks, credit risk and finance institutions, as well as mandatory individuals, institutions, and organizations related to legal follow-up processes, including third parties from whom we receive consulting services.
- Lawyers, auditors, consultants, and service providers.
- Your authorized representatives, guardians, and proxies.
- Other operators (For managing collection-related risks and preventing malicious uses, information regarding your invoice amounts and payment details related to electronic communication services may be shared).
- Banks and financial institutions holding your Turkish identification number, asset management companies, law offices, municipalities, business partners, and suppliers (Your phone number registered in the Türk Telekom directory may be queried and shared for legal and critical notifications, to prevent fraud and deception, and for marketing and promotional purposes).
- Credit institutions, financial institutions, banks, and similar organizations (During your banking and finance-related transactions via mobile lines, information such as SIM card changes and the phone number you are connected to the mobile internet may be shared for transaction and information security and identity verification purposes).
- Legal entities that have a commercial relationship with Türk Telekom and possess your phone number (Device information may be shared).
METHODS OF COLLECTING PERSONAL DATA AND LEGAL REASONS
- Your personal data may vary based on the nature of the service, product, and activity, and can be collected and processed through our authorized companies, representatives, dealers, our website, call center, and mobile applications.
- Your personal data is collected during the establishment of your legal relationship with our Company and during the continuation of that relationship from you, third parties, and legal authorities via the internet, phone, email, voice response, and text message; through physical, written, verbal, and electronic channels for the purposes mentioned above and in accordance with the provisions of Articles 5, 6, and 8 of the Law below. Your personal data is processed based on the following legal reasons:
• Your explicit consent,
• Being explicitly provided for in other legislation applicable to our Company, primarily Law No. 5809 on Electronic Communications,
• Ensuring compliance with national and international principles and rules related to customer identification, and fulfilling the obligations for information retention, reporting, and informing as stipulated by legislation and official authorities,
• Being necessary for the processing of personal data of the parties involved in a contract, provided it is directly related to the establishment or performance of the contract, to offer the requested products and services, and to fulfill the obligations of the contracts you have entered into,
• Being mandatory for the fulfillment of a legal obligation,
• Being made public by the relevant person themselves,
• Being necessary for the establishment, exercise, or protection of a right,
• Being necessary for the legitimate interests of the data controller, provided it does not harm the fundamental rights and freedoms of the relevant person.
• In cases of actual impossibility, if you are unable to provide consent or if the consent of a person who has no legal validity is required to protect the life or bodily integrity of that person or another person.
- Your special categories of personal data are processed based on the following legal grounds:
• Your explicit consent,
• Special categories of personal data other than health can be processed without requiring your explicit consent in cases specified in the laws,
• Health-related special categories of personal data can only be processed for the purposes of protecting public health, preventive medicine, medical diagnosis, treatment and care services, and planning and managing health services and financing, by persons or authorized institutions and organizations under an obligation of confidentiality without requiring your explicit consent.
IF YOU WISH TO CONTACT US REGARDING YOUR RIGHTS AND REQUESTS
In accordance with Article 11 of the Law, which regulates the rights of the relevant person, you can submit your requests through a petition prepared in accordance with the conditions specified in the "Regulation on Application Procedures and Principles to the Data Controller" (Regulation) by Turkish Telekom, depending on the nature of your request and method of application, in order to determine whether the application belongs to you and thus protect your rights:
- You can directly deliver your application to the addresses provided below in person, or send it by mail or via a notary.
- You can send your application using registered electronic mail (KEP), secure electronic signatures, or mobile signatures to the addresses specified below.
Applications made in this scope will be accepted following identity verification by us, and your requests will be concluded as soon as possible, and at the latest within 30 days, depending on the nature of the request. If a written response is provided to the application, no fee will be charged for up to 10 pages, and a processing fee of 1 Turkish Lira will be charged for each page over 10 pages. If the response to the application is provided on a recording medium such as a CD or flash drive, a fee corresponding to the cost of the recording medium may be requested.
